My H1B was approved for location A (MICHIGAN),ONE MONTH AGO.Now my employer wants me to work in location B(PA).My question-
Do I have to wait until labor is approved for location B or can I start working from monday and labor(for location B) can come in 10-15 days thereafter.I am a PT.

I went on March 11. I went in for 10 am appointment and was out at 10.10 am. Fulltime, first time H1B stamping. Simple questions - where did I do my education, what do I do in my current job, then the officer asked for W-2s from last two years and that was it.

Has anyone seen this pattern before for any service center? A "processing times" entry missing? Could this be just an accident, or are they sending the I-140's to another service center? This could mean a LOT to people who sent their I-140's and I-485's concurrently to TSC.

Hi Guys,
All my checks got cashed on friday....today my lawyer office got a notice saying that there is no FP fee eventhough they cashed it.
they asked to resubmit the fees again...my lawyer said he will work it out with them..
My questions is I filed to NSC, transfered to VSc and today they status says it has been transfered to TSC :confused:
So should i submit this evidence to VSC or TSC.
Please clarify.

hi attorneys,
my H-1B petition is valid for another 3 months. we applied for my H1 extn and my spouse H4 extn 2 months ago. both r still pending.
my spouse H4 petition expired last month. since we applied extn b4 it expired, my spouse can stay in usa legally.
now my spouse wants to travel abroad for a family function.
questions:
(1) is it fine to travel abroad with H4 extn pending? (pls note that the H-1B holder will not be traveling)
(2) if H4 extn is approved with new I-94 when abroad and my spouse gets another new I-94 at POE when returning, then which I-94 will be the latest valid one?

No, you don't. I had a stopover in London on my way back to India. I had a 6 month valid visitor visa of UK and didn't need any transit visa.

Hi,
Based on what I know, the medical exam has to be less than 1 year old on the date of I-485 application submission. However, I have seen different opinions on this forum. Some state that the exam date cannot be more than 30 days before I-485 submission, because the HIV test and syphyllis test (sorry if not typed correctly) are valid for 30 days only. Could anyone clarify this, please?

My I-140 got approved and priority date from EB3 got ported to EB2. I read in one of the forum threads that USCIS system would automatically identify that application is current and appropriate action will be taken. Also, I read about initiating interfile process of existing EB2 I-140 (current) with Pending I-485 application (under EB3). I am not sure whether I should wait few weeks before initiating interfile process.
I have given my biometrics in 2007 while filing I-485. Will USCIS send appointment for Biometrics again ?

I'm a little confused about my options in starting my H1 extension process and applying for my wife's H4 application.
Here is my current status :
6 yr H1-B period is ending on Dec 22, 2009. I'm getting married in India in October and will apply for my wife's H4 immediately after. Here are my questions :
1. Will there be any problem with my wife's H4 application if there are just 2 months of validity left on my H1 visa?
2. I could potentially start my H1 extension process now. I'm eligible for a 3 year extension since the Priority date of Jan 3, 2006, on my EB2 application is not current. If I was to start my extension process now, my approval may not happen before October and my lawyer there may be some problems if I travel outside the country on a pending H1 application. Should I apply for my H1 extension now or after I come back to the US in November?
3. If I was to apply for H1 extension in Nov and don't get an approval by the time of my current H1 expiry in December, will I be out of status?

I work for company A which is pretty stable,on a H1b visa. I've no problems except that you will not find another horrible boss anywhere. Trust me, I've worked in quite some places and I've seen pretty bad bosses, but with this guy, you have someone who will always make you look bad and will literally shout at you. I've had enough and I want to switch.
I've around 3 yrs left on h1. The new company will sponsor my H1b and they will start my GC on the first week of my starting. (the person hiring me is a good friend)
The question I have is, what happens to the h1 that company A is holding when I transfer to Company B . There might be a reason company A's CTO might not want me to leave. He also cannot do anything about my boss at this point. It gets little complex at this point, but I want to know if i can work part time on h1b for company A while I work as full time for company B.

You are better off applying visa in a home country. Usually the have better access to verify records!

I am adding my wife's AOS application to my own pending AOS application. Because of whatever reasons we couldn't file our apps together earlier.
I notice that I need to give my wife's Alien registration no (ARN) at a couple of places in the application package, such as in the I-485 form, G-325A form, and at the back of the photographs.
Needless to say, my wife does not have an ARN. I was allocated an ARN when my I-140 got approved. Since she is just a derivative beneficiary, she does not have an ARN yet.
So what should I do about these columns in the form. Should I leave them blank, or should I fill them up with my own ARN.
