Generally, the USCIS issues three copies I797A, I797B and I797C. Of these I797A is the Original approval sent to the petitioner while B and C are ourtesy copies sent that can be distributed by the petitioner to the beneficiary for his/her records and to the attorney for their records, etc... tyically, the USCIS and the Consulates require the form I797A for further processing the next stages.

I'm on H1b visa in my 6th year. Perm application has been filed and I hope to get it approved soon along with approved i-140 (fingers crossed).

From what I have read on this forum so far, H1b transfer to a new job after an approved I-140 seems to be possible even after 6 years on H1. My issue is that I currently work for a university (non-quota H1) so if I get a new job most likely it will be with a for profit company which would require me to get a new H1 (and not H1 transfer).

So, the question is whether it is possible to get a new H1 after 6 years on H1?

    Thanks for any help.

    Hi,

    My scenarios is this:

    > Got approved H1-B petition and visa stamped till 31st July, 2011
    > Traveling to US on June-15, 2011
    > Planning to do a premium filing for an H1 extension once I am in the US - i.e. soon after June 15, 2011

    1. Is there any rule that I have to be in the US for 8 weeks or so to apply for an H1-B extension?
    2. Will there be some issue at the port of entry as I will have only 6 weeks left on my H1-B visa?

    Appreciate any inputs on this.

    Regards,
    James A.

I was on F1 OPT a few years ago, so things might have changed since then. Please confirm with your International Student office.

We were explicitly told that we cannot do any credit earning courses while on OPT. That it will void our OPT. I'm assuming that these online courses are credit earning. I'd suggest you wait till you get yr H1 papers and move to H1 status.

    Hi All,

Would like to know if anyone has any H1B extensions approved/RFE's/denied (whether regular or premium processing) after the January 8 USCIS memo. Please indicate whether full-time or consultant.

I applied for H1B extension - receipt date December 23rd, 2009. Upgraded to premium on January 21, 2010 (Jan 21 date updated in case status on USCIS website). Working as full-time - (empoloyer is not into consulting), Extension is for 3 years beyond 6 years, I-140 approved.

Also, anyone know how long does it take these days for extensions under Premium processing to be approved.

    Thanks

I have 1-485 pending (my husband is main applicant for our greencard application).
I entered US last time using Advanced parole and I was working on EAD then. What should be my
    1. Manner of Entry
    2. Current immigration Status

I thought it's supposed to be Parolee with 1-485 pending. But only related drop down menu I cans see is PAR:Parolee. Is that what I should select?

I tried to find this in existing thread but could not find it. I will appreciate your help with this.

    Thanks a lot.

I got my H1 approved in Oct 2004 and it was from Oct 2004 - Oct 2007. I used only 6 months of H1 and later went on TN (work visa for Canadian citizens) and remained in US working on TN for 4 years. I was in US all these years. Now even the earlier H1 approval duration is over, Can I apply for H1 with another employer using the old 2004 H1 quota cap or it has to be under new 2009 cap? Thanks in advance.

Your H1 is NOT subject to cap as you had H1 in last 6 years.

Todays New York Times brims with immigration dysfunctions galore. The paper's immigration reports tellingly underscore the front-burner role this white-hot policy issue plays in the nation and the world. In the first section alone, we see: An open-mike faux pas by British PM Gordon Brown, referring to an immigration opponent as a bigoted woman, prompted his abject apology and now risks a Labor Party loss in the UK election next week; A controversial opinion piece and articles on the political, legal and economic fallout of the Arizona Peace-Officers Suspect-and-Arrest-or-Refrain-and-Be-Sued Act; A report on four Dream Act marchers...

The immigration news lately for the Department of Homeland Security has been decidedly downbeat: The GAO issues a scathing report on the DHS border fence initiative. DHS settles a complaint that attacked longstanding and deplorable immigration detention conditions in the basement of the Los Angeles federal building. The Chief Justice Earl Warren Institute on Race,Ethnicity & Diversity at U.C. Berkeley Law School releases a damning critique of Hispanic racial profiling in the Criminal Alien Program managed by DHS's Immigration and Customs Enforcement. With all this bad news, DHS may have overlooked a great proposal that the Department should support if...

Your I-485 will not go forward unti they receive the 140 approval.

I-485 petition will be undated automatically as soon as the corresponding I-140 is approved.

As far as I know, you don't have to inform uscis about your I-140 approval.

Immigration Visa Attorney Blog Has Just Posted the Following:
So far, the USCIS has announced that it received 5,900 H-1B applications for the normal quota and an additional 4,500 for the advanced degree quota. These numbers were released yesterday, April 7, 2011.

In years past, many remember that the H-1B quota was exhausted as early as the first day of applications. Last year, the H-1B cap was not reached until January the following year. I would anticipate that with the economy still rebounding, the H-1B quota will last a significant amount of time. This will also ensure that everyone who can find a job offer this year will have a chance to make an H-1B application. Please contact the business immigration attorneys at Fong & Chun, LLP for a free consultation if you are interested in applying for an H-1B this year! ---ecf

A traitorous American general hanged for aiding the British during the Revolutionary War -- one Benedict Arnold -- said rather cynically: "Law is whatever is boldly asserted and plausibly maintained." My recent EAD renewal had issues with the validity dates so I sent both the EAD (mine and my spouse) for correction. I received my EAD back with dates corrected but not for my wife. I called USCIS and one nice rep sent an email to the EAD supervisor requesting action but this was only a week ago. My wife now has a job offer but she is unsure if she could proceed due to lack of a EAD. This is obviously very frustrating for her since it was so hard to find a entry level job in this economy

I got a infopass but only for next week and it will be a little too late for the new job. She has to report to work next week. Any suggestions/thoughts for a way out will be helpful. FYI 90 days have passed since my initial EAD renewal application. I am considering opening a SR but that has a time line of 60-90 days

Opponents of comprehensive immigration reform often point to the 1986 legalization bill as a great failure that should not be repeated. What they don't want to talk about are the great number of success stories for people who were able to become legal. One story that is making the news 25 years later is that of Ana Hernandez Luna who gave an extraordinary speech on the floor of the Texas House of Representatives where she told her own story of her life as a young undocumented immigrant in the 1980s. The Texas Observer reported on her remarks: Tuesday, after it...

Most people know the story of this famous Austrian family that was the subject of the musical play and film The Sound of Music. Many may not realize that after the family fled Austria, they immigrated to the United States and brought their singing talent to American audiences. They also opened a lodge in Vermont that operates to this day. Father George and mother Maria passed on many years ago, but some of the children of that large family are still with us. Oldest daughter Agatha is now 96, but just a few years ago wrote a biography. Her sister...

She still has not been here the 1 year and 9 months she's required to stay married to me in order to fulfill all of the K1 visa requirements.

My question is; if she leaves the states and we have divorced, will she be able to re-enter the states?

USCIS has reminded all applicants for Adjustment of Status, Asylum, Legalization and Temporary Protected Status to obtain an Advance Parole (AP) document before traveling abroad. AP allows an applicant to re-enter the U.S. after traveling abroad.

In order to obtain Advance Parole, individuals must file Form I-131, Application for Travel Document to USCIS. The USCIS cautions individuals planning on traveling abroad to file Form I-131 well in advance of their travel plans (approximately 90 days before) in order to prevent possible conflicts.

We suggest all applicants of I-131 to file it in time to get the AP approval before leaving the U.S., otherwise it could have dire consequences and may result in an individual not being able to re-enter. Therefore, individuals that have a pending I-485 are encouraged to apply for Advance Parole before traveling abroad for easier re-entry if the circumstances of their current status changes.

You may be eligible. CIS usually requires 4 years of university-level education for a degree, or 3 years experience for every one year missing from a 4-year degree. An educational evaluator could say for certain if you have the equivalent of a US bachelor's degree.

    Hi,

I am in the process of changing employers and the new employer applied for the H-1B transfer on 4/11 at California Service Center (CSC). I haven't received my receipt number yet. Just wanted to find out how long it takes now a days to issue a receipt number because of the new H-1B rush during the first week of April.

If anyone has applied for H-1B transfer at CSC after April 1st, please update your status here to help others in the same boat.

Also, my start date is May 19th. Is it safe to join the new employer based on proof of delivery to USCIS instead of waiting for the receipt #.

Priority date of old EB3 case: Jan 2003 (140 approved). Started new EB2 case (PD Feb 2007) without notifying uscis of old priority date. Now EB2 140/485 pending since three months. Can I get early EB2-140/485 approvals if I notify uscis of my old priority date now? I belong to "other charge-ability areas" group.

    Hi All,

My H1B(8+ year) is expiring, and my company is willing to file H1B with Engg manager role. My previous H1B or extension was files for software engineer. My GC(EB2) is filed as Software engineer, with PD as Jan 2006.

    Questions
    1) Now is it ok to file H1B with new title? What if H1B gets rejected?
    2) How does this title change affect GC? Can the GC be cancelled because the title has changed or H1B gets rejected? The engg manager role is similar to software engneer role, except people responsiblities.
    3) If the H1B gets accepted, then is there still a danger to GC? Do they verify GC papers before approving H1B?

    Thank you, Raja

I am listening to the call. Debra Rogers from USCIS stated:
    1. Approx 300 k EB cases received in Jul AUG.
    2. All Family based cases entered and receipts issued.
    3. All EB based AOS applications will be entered and receipts issued by End of this month.

I have a work related travel (2 days max) coming up in January. Do I need a canadian visa. I am on AP and my US visa on my passport has expired. My H1 is valid till 2009 (not stamped on the passport).
My question is Do I need a canadian visa? Let me know if anyone had a similar experience.

    Thanks

If you are from a country who is not exempt from a canadian visa (especially for work), you should definitely get one. your AP does not entitle to enter any other country other than the U.S.

Hi, this might not be the right forum for my question but at least I am hoping that I can either can an answer or steered to the correct direction. So I quit my job in the US about a month ago because I was immigrating to another country. My job was located in Arizona and I immigrated to Israel. My company knew this was the reason I was quitting. So I am wondering if I should have received a severance package or unemployment benefits because of the reason of immigrating to another country.

    Thanks!

Bet on India (http://www.washingtonpost.com/wp-dyn/content/article/2007/07/28/AR2007072800999.html) The Bush administration presses forward with a nuclear agreement -- and hopes for a strategic partnership. July 29, 2007

IN LARGE PART, modern U.S. nuclear nonproliferation policy began with India. India received U.S. aid under the "Atoms for Peace" program of the early Cold War era -- only to lose its U.S. fuel supply because India, which had refused to sign the 1968 nuclear Non-Proliferation Treaty (NPT), exploded a nuclear "device" in 1974. Decades of U.S. noncooperation with India's civilian atomic energy program were intended to teach India, and the world, a lesson: You will not prosper if you go nuclear outside the system of international safeguards.

Friday marked another step toward the end of that policy -- also with India. The Bush administration and New Delhi announced the principles by which the United States will resume sales of civilian nuclear fuel and technology to India, as promised by President Bush in July 2005. The fine print of the agreement, which must still be approved by the 45-nation Nuclear Suppliers Group and by Congress, has not yet been released. But the big picture is clear: The administration is betting that the benefits to the United States and the world of a "strategic partnership" with India outweigh the risks of a giant exception to the old rules of the nonproliferation game.

There are good reasons to make the bet. India is a booming democracy of more than 1 billion people, clearly destined to play a growing role on the world stage. It can help the United States as a trading partner and as a strategic counterweight to China and Islamic extremists. If India uses more nuclear energy, it will emit less greenhouse gas. Perhaps most important, India has developed its own nuclear arsenal without selling materials or know-how to other potentially dangerous states. This is more than can be said for Pakistan, home of the notorious A.Q. Khan nuclear network.

You can call this a double standard, as some of the agreement's critics do: one set of rules for countries we like, another for those we don't. Or you can call it realism: The agreement provides for more international supervision of India's nuclear fuel cycle than there would be without it. For example, it allows India to reprocess atomic fuel but at a new facility under International Atomic Energy Agency supervision, to protect against its diversion into weapons. The case for admitting India to the nuclear club is based on the plausible notion that the political character of a nuclear-armed state can be as important, or more important, than its signature on the NPT. North Korea, a Stalinist dictatorship, went nuclear while a member of the NPT; the Islamic Republic of Iran appears headed down the same road. Yet India's democratic system and its manifest interest in joining the global free-market economy suggest that it will behave responsibly.

Or so it must be hoped. The few details of the agreement released Friday suggest that it is very favorable to India indeed, while skating close to the edge of U.S. law. For example, the United States committed to helping India accumulate a nuclear fuel stockpile, thus insulating New Delhi against the threat, provided for by U.S. law, of a supply cutoff in the unlikely event that India resumes weapons testing. Congress is also asking appropriate questions about India's military-to-military contacts with Iran and about New Delhi's stubborn habit of attending meetings of "non-aligned" countries at which Cuba, Venezuela and others bash the United States. As Congress considers this deal, India might well focus on what it can do to show that it, too, thinks of the new strategic partnership with Washington as a two-way street.
