Hi, my husband was killed in a road accident. He was on J1 and had very good publications and this happened when we were just wanting to apply for our green card, as he had very good credentials we would have got it without any problems. We had dreams of sending our daughter to best school for her college. Now with life turning upside down, I am enrolled in grad school to work on my phd and will take a while, but with this tragedy being recent dont really know how long its going to take to complete it and how future would be.
I want to know if there is any possibility that I can apply for immigrant visa on humanitarian grounds as it would be very difficult for me to live in India my home country due to social reasons as a widow with a little daughter.

there are two choices for - I140 Filing Type
- Regular
- Premium
What is the difference b/w two. Can EB3 candidate file for I140 Filing Type in Premium category.

Hi,
I am in US in L1 Blanket visa and is expiring on November 26th 2009.
I am planning to go back to India for renewal.
Suggest me the best option is to extend the status in US or to travel back to India for visa renewal.

How to determine to which service center we need to send our application packet? Is it based on the future job location described in the labor certificate or the present physical location of the applicant?
Applying concurrent: 140/485
present physical location(my present address) state comes under : TSC
Future job location state comes under : NSC

Earlier today, I mentioned this provision which would bar DHS from using funds to delay or rescind the no-match rule. The amendment passed by a voice vote, but in consulting with a knowledgeable source, it seems likely that the amendment will not have much affect. That's because it bars DHS from using funds from its 2010 budget for this purpose. As long as DHS rescinds the rule before September 30th (which now seems likely given yesterday's DHS announcement), no 2010 funds would be needed to achieve this result. I have a unique situation. Well.. I have been working for a Company A that is owned by my uncle. Iam on H1B in 2nd year and I have my I-140 approved 1 month back. Now I got a new job in another company B with 3 times the current pay of mine. I want to change to the company B.
My uncle said that he will continuing the process of my GC application, under EB2 in his company A. But I want to transfer my H1B only to the new company B, so I can get into the company B's payroll and get benefits. Can someone suggest how we can handle this without messing up with the current GC process with company A. Does changing to company B under new H1B impacts my GC processing. Can we show that the company A is processing my GC under future employement, though I worked for company A before..
Please advise the consequences and my options.. I badly want to work for company B..without stopping my GC processing with company A..

My wife is going for h1b stamping in Chennai on Jan 17th. She converted from H4 to H1 and and is doing her first year residency in a community hospital in New York. We have all required documentation. Letter from Hosp, 797, 129, LCA, offer letter, ECFMG certification, USMLE transcripts, degree, school transcripts.
In addition, I am asking her to take utility bills and bank certificates and paystubs.
As she was in h4 for 2 years, would the VO be asking her for my stuff like, my w2s, my paystubs etc????
Has anyone gone through this? Any specific questions related to residency? Does she need to take information about the hospital like brochures, etc.... does a visa interview for a Physician focus on the hospital and its operations????

My sister filed 1-130 for me in 1997. I am currently living in the US on an H1B visa and the I-130 has been approved. As requested by the NVC, my sister submitted her affidavit of support (I-864) and paid the immigrant visa fee. However, I recently found out that I should have filed I-485 instead. I was advised that I cannot file the DS-230 because I live in the US. Is this true? Which could/should I do, DS-230 or I-485? Is there a way to get the immigrant visa fee returned?
I will appreciate any advice.

Hi Friends,
I'm working with employer A and my PERM labor got certified with employer B. My second H1B duration ends Sep 2011 (12 months) and I can recapture 5 months.
1. Will I get 3 yrs of H1B extension if do the H1B transfer after my I-140 with employer B is approved.
2. Will I get 2 years of H1B extension (09/2011 + 1 yr with approved Labor) if I do H1B transfer now?
3. I went for a vacation and returned US just now. My employer A has generated pay stub only for a week and forgot to pay for the vacation. Is it Ok to submit partially paid last pay stub for the H1B transfer. FYI, I've all the other pay stubs for the previous months.
It'll really helpful to decide based on the folks replies. Thanks alot for the help.

I have a copy of Nolo Fiance and marriage Visas and in the section on I130 it says that my copies of G-325A must be filed in four copies printed on differently colored paper (white, green, pink and blue).
A) Is this really necessary?
B) If yes, I have actually bought paper in these colors. Does it have to a particular pink, blue, green etc?
C) The pages in the PDF are actually named
1) Ident.
2) Rec. Br
3) C.
4) Consulate
Which color matches which index? E.g. is the Ident one supposed to be white, blue, pink or green?
Hope someone knows about this.
