Hello,
I am a Canadian and have a PD of 3-05 LC apporved 10-06, filed i140 in 5-07 and am putting together the documents to send in 485 application this month.
I am on the 7th year of H1-b but have extension valid until 2009
In a few months I won't have a job. I am trying to apply for 485 before it ends.
Is it possible to find a job that is different than my current job description?
When I look for a job, what to I tell potential employer? do they need to sponsor the H1-b or Green Card? do they need a lawyer to manage my stuff?
What do I do after job ends? Does my family and I have to immediately leave? I heard that I can get a few months by applying for a different status (to take care of affairs) but that only get me a few months.
We were so happy last week , as our PD came up and we can go through the final stage to get GC... is all lost right now?
Would really appreciate some guidance.

I doubt if the house is going to toe the senate line on the CIR. The new bill that has been introduced in the House is seen as a rebuke to Bush, directly contradicting the Senate version. I think this CIR will be killed in the house if it somehow passes the Senate.

House minority (Repub) has very little power to block anything. In the Senate, one Senator can hold the proceedings ("filibuster") and kill the entire legislation. That's why they often talk about a filubuster-proof majority in the Senate. House members have no such powers.
In the house the majority party determines just about everything. However, since some moderate dems may not support the immig bill they do need some repub votes even to attain a simple majority to pass the bill. They may try to add more restrictrictive provisions against illegals to get some repub votes.
Eventually , the extreme right wing in the house is likely to go down kicking and screaming.
Unlike many members here I'm not that pessimistic about our chances in the house since the Chairman of the House Immig sub-comittee Zoe Lofgren is pro-immigrant.

Its delayed process and not a deliberate effort that is the reason for you not getting your LC. I see no logic for you to su DOL. I do feel bad for you but I will say sit back as these things some time happens with every one. I am sure you will be in good shape as Backlog processing Center will be finishing remaining LC's very soon.

If we get this thru do we still need CIR? Also I guess this looks more better with the limit introduced by an amendment (don't rememeber who it was) to limit the numbers doesn't come into play

I am in a silimar situation stuck at PBEC. I haven't posted anything because people are quick to come and bash (as you noted - even if we are just venting frustration - like the rest of everyone a few days back). Yeah, life is unfair but some things further add to it.
P.S. My husband attended the rally in SJ nevertheless (I was out of town.)

This should be a place to congratulate and applaud IV's achievements, instead of that to express one's own frustrations. People with 07 PD has the privilege to cheer when they cut in front of us, but we should not feel sad for being pushed back because it is a disruptive behavior.
Please do not list what you have done to add items in the legislation to help BEC victims, it does not look genuine any more when it is considered disruptive to express one's depression on a board specially for BEC victims.
This will be my last post, as I am sure they will ban both my ID and IP. For everyone who still reads my post, Good luck!

What freedom and justice you are talking about? The folks on this forum are not responsible for you misery. So stop venting you frustation here. Though, I sympathize with you situtation but unfortuantely the whole legal system is unfair.
What we have done here is a good start, soon we will lobby for passing of SKIL bill . And the day is not far when you too will be benefitted by these efforts

I was told that people on H4 are not eligible for SSN, and if I want she (the person on counter in ssa office) can issue me a denial letter for that. It sounded useless to me that time, so I didn't bother to get that letter.
This idea sounds good to me, I'll go to SSA office again and try to apply. Offcourse they will say that they can't accept application. So I'll get a denial letter and I can appeal against that.
They cannot refuse to accept your application. Fill in the forms and send them in. They can deny your application and then you can appeal. If they refuse to accept the application, you have two options. You can contact your congressman and complain. You can file a discrimination complaint with the SSA ombudsman. Here is the discrimination form.

Finally, if you believe you have been denied your rights because you are an immigrant, you can contact your local ACLU and ask them to represent your case. As a last resort, you can file a lawsuit at the federal district court. The filing fee for this is $350. However, I hope we are all doing this to exercise our rights rather than for the money. At least that is my motivation.
In my case, the first time I called, the person hung up on me. But I did not give up. I got them to accept the application and it is currently under reconsideration. I was also able to get a response from the Regional Office. So far they have not addressed any of the points I made in the original case as described in the OP. I expect they will continue to ignore their own laws and regulations, until I appeal this to an administrative judge, who will make a legal ruling.

Skills in general are typically formed by three components:
a) 1/3 - Formal hands-on Training
b) 1/3 - On the job experience
c) 1/3 - Reading, research on your own
If you have some indirect project experience by working as a programmer for example, I don't see why not you cannot do items a) and c) above. At least the PMP (or whatever certification you intend to take) will be ready when opportunities come and the training should help you expand your horizons. Good luck.

USCIS adding up all 140's together and asking companies to prove ability to pay for all candidates together
department of labor auditing just about every eb2 labor
vermont and california service center giving very difficult rfe's to h-1b's - change of employers and extensions (they are actually denying them to)
Consulates sending complaints to department of labor when h-4 goes for visa stamping and they see primary hasn't received paystubs from entry into usa
companies closing down because fines/penalties from department of labor are too much.

It really seems that the government is making a concerted effort in giving the employers and employees a very difficult time. Started getting tough in 2004 but have really ramped it up a notch in last nine months.

My I-140 was filed on July 9, 2007, USCIS received it on July 10, 2007. Just heard from lawyer that they received my 140 receipt. The date on the receipt is July 16, 2007. My I-140 was sent to NSC.
