December Visa bulletin is obviously frustrating for all of us. After the recent accomplishments in July visa bulletin and the tons of approvals that we saw after that, we hoped that everything will be alright.
But that did not happen. Some of us in the community were taken by surprise, but this was expected. Afterall there are only 140K greencards available every year. EB2 for India and China is already used up for the quarter. EB3 is badly retrogressed for everyone.
Believe me, it will not get any better. It will get worse with time if there is no immigration reform.
IV can only do what its members empower it to do. If members want us to be just a site for question and answers for individual visa problems we can stay like that. If members want us to come together and do a rally in DC, we will help organize it. We did a rally in DC on Sept 18 and made great progress. However we cannot just sit back and admire one effort. We need to continue it and capitalize on it.
Now is the time for everyone to decide if they want a greencard. If you need a greencard, and want to do something about it, then you must join this effort and help yourself by helping everyone.
Our Plans
Our next hope is year end bills. If we can get some provisions in those bills we can certainly look forward to a happy new year with fast movement of visa dates. Next year is an election year and it will become much tougher for any immigration bill to pass. We will need to make super extra push next year for something to happen. So the time to act is NOW.

Came to USA in 1999 to do MBA from a top US school. Joined a multinational org in 2001, filled my labor in 2002, got laid off in 2005, Filled my another labor in 2005.

Frist, sorry for the confusion. I do have a 05/2007 PD at Atlanta PERM center. I came to the country in 1999 for grad school, started working with OPT in 2001, converted to H1 in 2002, laid off in 2002, started working again in 2002 with a new employer, filed labor in 2004 and got stuck in BEC ever since. The employer refused to file PERM, so I had change to a new company in 2006, and had PERM filed in 2007 and got stuck there again. Your are right, I am technically not in BEC, but psychologically I always feel I am in there.
I did not know what was 'disruptive' and 'inappropriate' about what I said. This is a board for BEC victims, so BEC victims are not allowed to express our frustration? I just expressed my depress and my concerns over how much this will retrogress the PD without targeting anyone. When tons of people run in front of our queue and shut us out in cold, we are supposed to 'enjoy the moment' with them? If so, when USCIS said no one can file 485 on July 2nd, why none of the people enjoy the happiness with those who already filed, because that will make their processing time much faster. People said we should feel happy for those who can file, because they now can get EAD/AP for their spouses, as if our spouse do not need EAD/AP. And as a result of this total mess, I don't think we'll have hope in another several years to see the date current.
IV core keeps telling us, BEC is always on their agenda. Really? If they did not even understand our pain and consider our frustration a disruption to people's happiness, how can we expect them to help? I still think IV is a great org, as it's the first such organization to speak out for legal immigrants. But when it comes to BEC victims, I did not see IV changed anything, or intend to change anything.

I think the intent of the provision is that this category of people not be subject to labor certification, but there is no language in the bill that says that.
Here's the summary from Sen Frist's website:
Section 405. Student Visas.
Section 405 extends foreign students� post-curricular Optional Practical Training (and F-1 status)
to 24 months. It also creates a new �F-4� student visa for students pursuing an advanced degree
candidates studying in the fields of math, engineering, technology or the physical sciences. The
new visa would allow eligible students to either to return to their country of origin or remain in
the United States for up to one year and seek employment in their relevant field of study. Once
such a student received such an offer of employment, the individual would be allowed to adjust
status to that of a legal permanent resident once the alien paid a $1,000 fee and completed
necessary security clearances. Eighty percent of this fee would be deposited into a fund for job
training and scholarships for American workers, while twenty percent of the fee would go
toward fraud prevention.
So if you would have qualified for the F-4 visa if this bill had been in effect at the time of your graduation and you have secured employment in the US, you can adjust your status.
Plus, Section 406 says: if you have been employed for 3 years, then a visa number will be immediately available to you. Otherwise, Section 405 still says you have to wait till a visa number is available.

Thanks, Andy. So, 80K LCs a year, 10%-15% of them will probably never get to AOS stage, 20% of those were duplicates (for people with petitions stuck in the backlog centers), so we are talking about 50-55K new labor certificates each year that will result in I-485. This is very consistent with 85K new capped H1Bs plus whatever number of exempt (non-profit research) H1Bs every year. So, we are talking about 100-110K total AOS applications (with dependents). Now lets take 140,000 EBs, substract Schedule A and EB1 (no need for LC), and there is probably 10K extra EB visas should be left over each year (quota less new potential EB petitions). Those are probably going to land in EB3 ROW. That means the retrogression will become less severe. What we are experiencing right now, is the rabbit that moves through the snake - the EB petitions resulting from a higher H1 cap several years ago.

Mirage..you are absolutely right...i paid 765$ as per old fees for I485,EAD,AP. the new fees for I485 is 1010$ and EAD,AP can be concurrently filed with no fees.also, since I485 is filed with new fees there will be no fees for renewals.so, basically 1010$ one time fee with the new fees structure and 765$+645$(EAD+AP) with every renewal every year.(if it becomes 2 years then for every 2 years).i wish i had paid thru new fees.this is completely unfair and big BS......

Kartik, as long as we, the EB3 do not come forward and collect huge amount for lobbying, we will continue to lurk here for many more years.
Unfortunately the sad part is, whatever lobbying is done actually helped only EB2 I, may be due to a wrong notion by USCIS that all Hi-tech immigrants are EB2. This could be a fact as there are thousands of 245 cases that fell into EB3.
Another bad thing was that USCIS release this VB yesterday which means one extra day to CRY.
I do not blame any one, but ourselves. We do not want to spend money and hence dying in this process. No solution, but cry at every VB day.

I was Dem leaning too, and I liked Hillary. But Obama has in no way been running the honorable campaign. He is using others to do his dirty job, if you think otherwise, you too have been sold on the propaganda of the left.
when obama made a sexist remark, what did the press do? Nothing. Let us see what happens if his opposition makes a even a hint of racist remark. I am sure then that the republican campaign will be pounded by every media outlet in the country.
Again, not to say I like republican ideology, I am very left leaning in my thoughts and actions. However at this time, I see that majority of the left is leaning towards Obama just for the sake of leaning towards left, and not on the merits of candidacy. And such thing is bad for everyone concerned (even the world, because like it on not, what happens in USA doesn't just stay in USA) -- Obama has already demonstrated that he is nothing but a political opportunist. His comments on Israel (I liked his statement, but not his intention) and the eventual recanting, and among many other examples, shows that he is just unqualified to be the President.
And for the records, McCain in not running for the job just based on the fact that he was shot down. He has considerable amount of experience working in the Senate and knowledge of world issues, and American issues too.
Give me a break. McCain is running a honorable campaign and Obama is running a dishonoSrable campaign. Can you give me an example close to the "teaching sex to kinder garden" sleazy ad from McCain camp?

Saint or no saint, we don't want 'drill baby drill" guys and "God is running this war" nuts in the white house. You will have more problems in the economy and useless debates on abortions. We need to push them in the right direction and demand them they carry through their promises. We may not have the right to vote, but the outcome of this election will impact us and around the world.

To ensure enforcement, the framework also calls for increased border patrol personnel, resources, and technology, and lays out a policy for administering temporary work and student visas.

Please be considerate to your good employer and good attorney of yours. You do not want to burn bridges, when you leave. Give them at least 2-3 weeks notice. That is the least or at least work with them for 6 months since that is what the law would require you after getting GC.

Is it really that bad in canada? I think if you are looking for jobs (no.s & salary) comparable to US that won't happen. But I think the general quailty of life in canada is pretty comparable to US.
Same school system/corporate env/law enforcement/etc ..
I don't think any place will compare to living in US as far as # of available jobs/salary is concerned. You may find more jobs in India but the general quality of life in India is still sub-par. If it were really at par with west, nobody would be trying to immigrate here.
I am sorry to tell you that by going to Canada, in the end you may be better off going back home. I lived there as a PR and I have many Canadian citizens that are tired of the lame system back in the Socialist Canada.
As a general note, I think if you have already been in US 8-9 years you have already made enough investment and sacrifice. Its worth waiting for some more time. But set your own timeframe, don't wait endlessly. Trust me this can go on, this might be a well thought poicy decision to slow down processing at BEC's and introduce retrogression. This will trigger a lot of ppl like us to leave and they can get the work done cheaper (off course, there is always more ppl ready to fill my shoes).

Also, as we know the severity of the retrogation is not completely due to visa number unavailability. USCIS never used the full 140k - many years - due to the inefficiency of their process, FBI name check backlogs, may be work force shortage etc. We are beginning to see some improvements in those areas. There is an increased awareness of EB backlogs due to efforts of IV. I would say, the future is looking promising.
