Hi,
I Filled 485+EAD+AP in July fiasco with old fee structure, In July 2008 filled AP+EAD with new fees.
Planning to file AP alone for 2009, I read somewhere that if you paid new fee's for AP then you won't get charged next time.
I am not sure whether I need to pay AP fess again this time or not?
Please share your exp

In the scenario presented above, or where USCIS erroneously issued a GC when PD is not current, the obligation on the GC applicant's part is to report the error for appropriate resolution by USCIS. Even if the GC applicant (like my best friend who got his GC in 2008) is not aware of the detailed process, and is not tracking RD, PD, ND, the applicant still has an attorney who is representing the applicant. Also, filing the I-485, doesn't automatically guarantee the issuance of a GC (eg of withdrawing $100, expecting to get $100 but getting more than that amount - comparison is not apples to apples when talking about expecting GC after you file I-485).
In the end, when these situations occur it boils down to doing what is ethically and legally appropriate, within an appropriate response time frame.

You should be very happy that it was approved quickly. I did not get my EAD which was applied in July 2007 and it is been more than 320 days...

Prince charming - I invoked AC21 sometime back after 180 days of filing 485 and moved to a new job on EAD.
My ex employer revoked 140. At this point of time I did a lot of research and found out the following things
(1) AC21 letter never reaches your file - there is no system in place for AC21 letter. G 28 gets into the system because there is a process in place for G 28
AC21 is a law that allows you to change jobs but there is no system in place.
(2) AC21 letter must be provided upon request - different officers want differtent information so they generally issue a NOID and ask you to submit evidence in 30 days. USCIS in some cases sends out straight denials. The denial letter generally has information to file MTR within 30 days if the case needs to be reopened due to USCIS error.
In August when my case was being processed, they sent me a NOID but sent my wife Fp notice - I called customer service and was advised that she can go for FP as usual but I have to respond to NOID before they move forward with my case and I promptly responded with AC21 and my case status changed to "Case reopened, response received" and there were soft LUDs hitting my 485.
Keep all documentation ready and be proactive, you can hire a good lawyer from MTR, remember that when you file for MTR, you cannot work - so before you inform your employer, get a letter from them and then inform them - in case employers will be reluctant to give any documentation if they know you cannot work for sometime. If you are on h1b you dont have to worry.
MTR approvals can take 3 to 5 weeks or more too.
if not on h1b you start accruing unlawful status and usually lawyers suggest that you stay till less than 180 days when your MTR is filed - it never takes 180 days for a decision on MTR so dont worry about unlawful status.
These are hidden risks in AC21 but good news is that AC21 cases have always been successful.
You may have to go through this period of uncertainity.

I was 100% determined in the beginning to attend the rally, but could not for the following reasons.
1> I was in Dallas and family in SoCal for last 9 months(from Dec 2006 to be precise). I used to meet my family every other weekend. Was trying very hard to find a project in Socal, and finally I got one where joining date was Spet 13th. I could not dare to ask for leave in the very first week. To tell you the truth it took so long b'cos of H1 status, everybody wants me to transfer my H1 or they are looking only for GC/EAD holders. Hoping to get EAD soon.
2> My husband was planning to attend but somewhere in Aug last week we got FP notices and date is Sept 18th. The FP letter clearly mentioned that postponing might cause delays so we decided that he also has to drop the idea.
Of course we contributed towards the rally.
I am very proud to be part of such excellent grass root organization and now since I am in Irvine I can be active in Socal chapter.
Also we are eager to join in the next rally and have total faith in IV leadership.

Your message............................ : I would never ever fly Air France, because I am a resident of India and your Airline treat Indians very badly, discriminating because of the country of citizenship and color. Shame on you for making 55 Indians wait in the airport for more then 12 hrs while the rest of passengers (non-indians) were arranged to go and stay in a hotel. Shame on you for ill treating the passengers in your Country (Paris, France). 1 less customer for you Air France!!! My suggestion: Change your attitude. Don't give substandard treatment to non-white passengers.

Flight AF 218 from Paris to Bombay, operated by an Airbus A330 with 169 passengers and 12 crew members on board, left Paris-Charles de Gaulle airport at 12:45 on 10th May and returned at 20:06 on the 10th of May, as while en-route the pilots noticed some vibrations from the Cargo hold, which could not be checked during the flight.
At Paris-Charles de Gaulle, under the supervision of competent authorities, checks were carried out on the technical state of the aircraft but no abnormalities were found.
Passengers with a valid transit visa were put up at nearby hotels for the night. Also despite the fact that transit visa�s are issued by the immigration authorities, Air France staff mediated the issuance of visa�s which turned out to be a time consuming process. Needless to say passengers were taken care of by the Air France ground staff who spoke fluent English and passengers were also provided with food and water.
All the passengers were transferred to another Air France aircraft the next day, flight AF 218A which left Paris-Charles de Gaulle at 14:15 and reached Mumbai safely. Air France regrets any and all inconvenience caused to the passengers due to this incident. At all times, the main concern of Air France is to ensure the security of passenger.
I do hope that the above explanation will help soften the negative impact of this situation and hope to have the privilege of welcoming you aboard Air France in the future, to your entire satisfaction.

You are missing the whole point. If it was the way they worked it's fine, or if that's the way they are going to work that's fine too. But the only reason this was being done so fast is to churn out the maximum pending EAD's with 1 year approvals, so they come back to us with $340 checks next year. If it wasn't greed than they wouldn't have put point 5 and made EAD free only for post July 30 filers. If they were really loaded with application they would have done 2 years AP too.
And don't talk about India here. We are the people who paid peanuts to study Engineerings, doctorates etc from world renowned Institutions. We harldly pay for any services provided by the govt. And above all, what are we doing in return to our countries since we left. We never even bothered to go back and check how's our motherland doing.
I feel we don't have any right to talk about India....
To what one member said; we don't like it both ways. A question to the original poster. Had this been an emergency and USCIS delayed your EAD by three weeks, I bet you would be screaming and yelling at their inefficiency. Yes, the system is broken. Look at the bright side. At least an attempt is being made to fix it. If this were India you would be paying a hefty sum to God knows how many people to get something as simple as a birth certificate. And let me ask you one other question. When was the last time you picked up a phone and called your local MLA hoping that he or she will resolve the water problem in your area? Again, you would be paying decent money and runaround the MLA's private secretary to get ten minutes on the MLA's calendar.
So dude, put-up or shut-up. Things are changing and if you want it any faster then you should give up your day job and dedicate yourself to the cause.

Guys, temper your expectations. Cust Service Rep at USCIS are not trained to answer the questions that pertain to things like visa bulletin's effective date and whether or not they will accept the ones or reject the ones on July 2.
Cust Service Rep is for general information for those who cant or wont use the USCIS website and other sources of information on the internet. Or for those who dont speak English.
Cust Service is not intended to provide complex answers. Last I heard, even the Vermont service center folks didnt know about bulletin revision and they were turning down 3-year extension requests for H1 visas thinking that the bulletin is current until confronted by lawyers who said that bulletin is unavailable and now there is reason to give out 3 year extensions instead of 1 year extensions.
If Vermont service center was unaware of visa bulletin revision, then what do you expect from a Cust Service Rep who is trained to answer questions that cover information that can be fit in 20 pages ??????

If my attorney is to be believed, USCIS will clarify on Wednesday regarding whether/how to file without receipt notice.
BTW turns out I'm with Nebraska SC too. I had just assumed I would be in TX given that I live in TX! :D
Lets wait till Wednesday then.
I still believe we should be able to get the receipt numbers by 1-Aug.
