Great points. Is it possible for the primary applicant to continue on H1 and the secondary/dependant applicant apply for EAD?
I have the same issue now , my h1b 6 years end in 2007 december , h1 extensions are granted only if the labor is pending for more than a year or dates are not current for 485 ...
So I guess we are better of being on EAD rather than on H1B because of all the bad publicity associated with it now a days and kind of restrictions they are planning to bring on H1B.
Even the dual intent is gonna be removed if the bill passes in its current form. Looks like senate is trying revive that unwanted baby called CIR ....
Even if CIR fails , the chances of enacting 1035 on its are very high So in a nutshell its better to get to the 485 queue and wait so that they will start some preprocessing on 485 applications after year at least.
All of us know that dates will move back and we have to get ready for that ..

Patience my friend - iv is a disparate group of people some of whom like you are hungry for action and others who are busy caught up in stuff. Getting to organize a group is tough in the best of times and given the current environment when they are in the line of fire of congressmen backed by hordes of hate-mongers and anti-immigrants masquerading as public-policy specialists and grassroot actvists with a friendly media filled with reporters who are ambivalent about immigration themselves, you can't expect a group to form overnight to tap your energy and skills! Why don't you do some research meanwhile - I have been trying to find out something about the director of a group called cis which wields enormous - or ginormous is more appropriate- influence on the current debate and I cant find anything about him beyond where he went to school! granted he is not a politician so we're not entitled to personal details and i'm least interested in it but for someone actively influencing public policy and discourse with millions of lives on the line, so very little is known about them. Once again, dont expect people to be courteous and receptive to courtesy overnight.

What is fair is that we treat everyone here (and everywhere else for that matter) with respect without regard to the country of birth or the EB category. Some are more educated than others, some are more skilled than others, and some are more lucky than others when it comes to green card but what is common to everyone of us is that we are in this mess together. To be honest I don't think we are here to figure out what's best for United States, we are here to get our green card, live the American dream, and make the best out of it.
Therefore, let's not make this GC journey anymore difficult than it already is by fighting amongst ourselves about who is more skilled and who is more deserving. Besides, constant bickering among the IV members will only further divide and alienate more members and won't help us in any way so I suggest that we avoid doing/saying things that has the potential of dividing or alienating members.

Jaime, your thought of having one more rally in Silicon Valley is a good one but again you are going to have the same crowd..!!
People in neighbouring states of DC did not make it , you tthink they will make it all the way to west coast! very doubtful!!
We should aim at bringing in more people to this family as possible..
Looks like a simultaneous rally on a weekend will be very effective!
And this time for the rally we will carry one one slogan banners
'SHORTEN THE WAIT FOR LEGAL IMMIGRANTS' or something similar!

I was thinking Silicon Valley because many of us live there and the folks there are very proactive! (Look at how well California did in DC!!) and the first San Jose rally went great even with the short planning time. I was thinking that with more planning time and with a lot of proactive people who already live there it would be easier to get much bigger crowds! We didn't have 1000s of people from California in DC only because they are the farthest away which makes it hard for many of them to attend.

Bottom line is Porting of PD from Eb3 to Eb2 worked for some people only.
It sucks that we cannot use a completely legal avenue without depending on luck. Does USCIS have an explanation for this inconsistency?

People from south may be educated, techy but very discrimating and hyprocrate. Why do u need any ideas/thoughts for that? Someone can look up the flcdatabase as they looked for Level 3 and Level 4.

I had a good experience with AI when I travelled with them. Flight was near empty, everybody had 3 - 4 seats to sleep on in economy class. Service was ok. Now they offer non stop flights at a great price, I would seriously consider them, overall well worth the price.

If your case is EB2 worthy. It makes a lot of sense. I have many friends who did that and they have their GCs now. While I'm rotting in this mess... my fault: I didn't convert to EB2 which I could have.

How would one decide if the conversion has merits? In my case, I have EB3(I) PD of 2003. In the past 5 years, I've gained progressive experience thru my job. Is there any benchmarks or guidelines on when to convert from EB3 to EB2?

Yes I've called the rebate hot-line (i think it was the main IRS number and reached there by choosing the rebate option)
The agent was very helpful. It was a while back - i had e-filed, but did not check the box for electronic refund (i had to pay) - so it was treated as a paper filing for this case - and got the check on the paper 'schedule'

Congratulations to all IV members for being able to apply for I-485. This is GREAT news. Please please apply for your I-485 at the earliest. It would be best if your application reaches USCIS in the week of 2nd July. Here is the link to July Visa Bulletin:

Please stop posting such rude and derogatory posts for people stuck at BECs. It's very easy to criticize if you are in a better position than someone. But remember, you could also have been one among them. Then, if you were expressing your dissatisfaction and instead have people call you losers, you wouldn't begin to imagine how that feels. If you are from India or from a country which fought for its freedom, you would not ask this question.
When M.K.Gandhi held his first rally against the British rulers(nothing personal here Franklin and Mark :) ), it did not result in immediate freedom, but was it worthless ?
It's not just India that won freedom either, don't forget USA!
Although I do admire Gandhi's approach more.

If Britain still ruled India, I'd probably be marching with you in India!
What would rather you tell your children, "I sat at home and read the forums", or "I marched in the streets".

I also do not understand why H4 are not eligible for work permit. I think when they passed H1b, they did not lobby for H4's to have work permit as they probably did when they introduced L1/L2 and E1/E2 visas. The onus is on us H1b holders to ask for H4's to have work permit. So I hope IV adds this to their list of goals if it is not already one. Lot of people understand that current H1b limit is not enough so this could be a good option if they are reluctant to increase the H1b cap.

It seems like the group I am currently working in will shutdown in few months and more than half of the people have left the group already. I, therefore, need to find a job in next 4 months or so. I am a computer engineer by profession but trying to pursue a career in SAP functional field or DBA and looking for some advise from professionals in the field on training requirements/opportunities, career opportunities in different SAP modules, and how to basically get started.
