Hi All,
I have H1B stamped from company A which is valid untill Oct 2008. I am planning to go to India in Jan on my new transferred H1B from company B.
Do I have to take an appointment in India for getting my new H1 stamped? Or can i just show my new approved H1B from company B on my port of entry in US, when I come back?
New Approved H1B is enough.You don't need visa stamp again.

White House Press Secretary Robert Gibbs said there are not enough votes for the Obama administration to achieve its desired immigration reform, and change in the system as we know it today.
The plan was derailed when conservative activists, who claimed the program would have constituted "amnesty" for illegal immigrants, managed to pick off enough Republicans in the House and Senate to forestall a vote. Gibbs said that the White House would make an effort, though, to win the votes for a reform plan, for which President Obama reiterated his support.

Hi,
My wife is on H1B and she couldnt work for the past 6 months. I applied for my I 140 and I 485 during the July fiasco last year and she was not added as my spouse and we got married at a later date.
Since she didnt receive pay for 6 months, I guess she is out of status for these 6 months. So my question is will this have any effect on her GC process when I add her as my spouse to the I 485 application whenever my priority date become current ? I am really worried and dont want to screw up my GC process after a long wait.

One of my friend got their Fingerprinting letter and the last name is misspelled. What should they do go ahead and take it to the FP office or call USCIS and get it corrected.

My I-94 extension (for L1B visa) was denied on Oct '08 and I returned in 4 days after they updated Denial status. Reason for denail is "lack of specialized knowledge". I am planning to apply for L1B again in next month (By showing additional certification). Can you please advice me
- is it fine to apply for visa again as it will be more then 6 months after it was denied
- Do I need to show the copy of denial notice during visa interview? Is there any thread available providing suggestions for those applying for visa again after it was denied earlier...

Hello All,
I am stuck in a very painful scenario right now. I am working on F1-OPT which ends on Feb 5th 2011 and have a pending H1-B application under premium processing. The thing is my employer says that they will terminate me on Feb 4th and cannot guarantee a rehiring even if H1-B is approved.
My employer needs to know if there is something (legal) like temporary termination and rehiring ? If yes then what does the employer need to do to rehire. And is there any documentation about this. My employer wants to check this documentation before reconsidering.
Any inputs would be appreciated.

I am a chinese. My company would like to support my green card applicaion this year. I also plan to be married this year or early next year. My wife is a F1 student from china.
As I know that my wife can be a dependent in my green card application. If I start the green card application process from next month, is it ok that I add a wife as my green card application dependent if we get married at around Nov 2011.

Not surprising, but surprising that Luis would admit it. And if this is the case (and I think it is), then the question is whether we wait until 2011 or later to push again or finally decide it's time to look at other strategies like piecemeal reform (pass DREAM, AgJobs, legal immigration reform now and deal with legalization later) or look at administrative actions like TPS or parole and a moratorium on deportations for people who would otherwise meet the requirements of a proposed legalization program.

It is valid from the date it is issued and they shld enter the US before it expires. However at the port of entry, the consular officer may chose it give it beyond the actual expiry date.

UH! Interesting..Why is that difference this time and did Mumbai visa mistakenly has put China EB3 date? But 'i hope US Visa bulletin Oct09 they will correct it to 22FEB02 for India EB3?..Let's pray!
