Hi all, I have a question regarding my current situation. I'm currently working for this non-profit organization under my OPT that is good until the end of Oct of this year. My question is basically whether or not I can ask my employer (already agreed) to petition for me for an H1-b visa? Can I still apply right now before my OPT expires or would it be better to apply next year on the first day of April? If I can get an approval for my H1-b would it be good to get a TN in the meantime and later have my employer petition me for an h1-B then?
Any suggestions would be greatly appreciated as I don't want to waste the opportunity to apply if I can get one at this time. I heard is better and easier to apply for one while under OPT than TN to H1-B but I'm not sure or rather confused about this!

Some decisions and cases support that a corporation even if it is owned and operated by a single person may hire that same individual in an H-1B capacity. This is based on the concept that the corporation is a separate legal entity fron its owner. However, self-sponsored H-1Bs are subject to careful review. My friend John Lamb in Nashville blogs today about ICE's Hutto detention center where whole families are jailed while awaiting deportation. I'm reminded of Charles Dickens' tales of debtors prisons in Victorian England where "lawbreakers" who violated British laws relating to debt were jailed right along with their spouses and children. This is very confusing. I already sent my I-485 along with a new filing fee of $1010 in total $930 for the application and $80 biometric fee last August 3rd. USCIS already received my application my question is are they going to reject my I-485 b/c they just revised that we have to pay the old filing fee for July Bulletin? I used The current I-485 form version dated �7/30/07 Y�.
I'm so confused! Due to this, I'm just gonna send another application b/c the chances of them rejecting/returning it back to me is High. If they don't return it back this week then I won't be able to file my I-485 after August 17th. Is ok to send another application? Can I just attach an explanation? I would rather take this chance than not being able to file it again after Aug 17.
Can someone please tell me the old filing fee including the biometric fee??

I am currently on H1B through company A previously I was working for Company B before that was working for Company C.
I transferred my H1B from C->B->A, Because of current Economy now my employer(Company C) is saying that if I lose my current project at client location he is going to cancel my H1.
If that happens can I go back to B Or C company, as My previous companies never cancelled my H1.
Appreciate any help here.

Hello, My parents on B1 visa just entered the US a few days ago. This is their 2nd visit. I extended their stay beyond the given 6 months when they came last time. My mother got a 6 months term on her I-94 this time which is ok but my dad was granted only 60 days of entry and he said the immigration officer has marked in Black marker pen saying "No Extention" on his I-94 card. The justification they gave was that they were unable to find his previous extension, but if they were unable to find his extension, how could they even permit his entry in the first place since overstaying without extension would be illegal.
My question is with "No extionsion" marked in writing on my father's I-94, could I apply for his extension beyond the granted 60 days?
Please answer this question so that I can take the needed action.

I recently got my H1 3 yr extension based on I-140 approval, I want to change my job to company B but my employer Company A says that he will have to revoke the I-140(as per company attorneys), Will this affect my H1 extension(as in will I be out of status?) and can I retain my PD?

I am a strong supporter of Comprehensive Immigraton Reform (CIR). I have been on both sides of the fence. In the late 1970s and early 1980s, I was an attorney for the Immigration and Naturalization Service. I spent a couple of years representing the government in deportation proceedings, often conducted in Federal prisons. Are there people in the U.S. who should be deported? Absolutely!
