Generally, the USCIS issues three copies I797A, I797B and I797C. Of these I797A is the Original approval sent to the petitioner while B and C are ourtesy copies sent that can be distributed by the petitioner to the beneficiary for his/her records and to the attorney for their records, etc... tyically, the USCIS and the Consulates require the form I797A for further processing the next stages.

I'm on H1b visa in my 6th year. Perm application has been filed and I hope to get it approved soon along with approved i-140 (fingers crossed).
From what I have read on this forum so far, H1b transfer to a new job after an approved I-140 seems to be possible even after 6 years on H1. My issue is that I currently work for a university (non-quota H1) so if I get a new job most likely it will be with a for profit company which would require me to get a new H1 (and not H1 transfer).
So, the question is whether it is possible to get a new H1 after 6 years on H1?

> Planning to do a premium filing for an H1 extension once I am in the US - i.e. soon after June 15, 2011
1. Is there any rule that I have to be in the US for 8 weeks or so to apply for an H1-B extension?
2. Will there be some issue at the port of entry as I will have only 6 weeks left on my H1-B visa?
Appreciate any inputs on this.

I was on F1 OPT a few years ago, so things might have changed since then. Please confirm with your International Student office.
We were explicitly told that we cannot do any credit earning courses while on OPT. That it will void our OPT. I'm assuming that these online courses are credit earning. I'd suggest you wait till you get yr H1 papers and move to H1 status.

Hi All,
Would like to know if anyone has any H1B extensions approved/RFE's/denied (whether regular or premium processing) after the January 8 USCIS memo. Please indicate whether full-time or consultant.
I applied for H1B extension - receipt date December 23rd, 2009. Upgraded to premium on January 21, 2010 (Jan 21 date updated in case status on USCIS website). Working as full-time - (empoloyer is not into consulting), Extension is for 3 years beyond 6 years, I-140 approved.
Also, anyone know how long does it take these days for extensions under Premium processing to be approved.

I entered US last time using Advanced parole and I was working on EAD then. What should be my
1. Manner of Entry
2. Current immigration Status
I thought it's supposed to be Parolee with 1-485 pending. But only related drop down menu I cans see is PAR:Parolee. Is that what I should select?
I tried to find this in existing thread but could not find it. I will appreciate your help with this.

I got my H1 approved in Oct 2004 and it was from Oct 2004 - Oct 2007. I used only 6 months of H1 and later went on TN (work visa for Canadian citizens) and remained in US working on TN for 4 years. I was in US all these years. Now even the earlier H1 approval duration is over, Can I apply for H1 with another employer using the old 2004 H1 quota cap or it has to be under new 2009 cap? Thanks in advance.
Your H1 is NOT subject to cap as you had H1 in last 6 years.

I asked my attorney if we could anything about the delay in the issuance of EAD. My attorney mentioned that she would send an e-mail to USCIS. Is there an e-mail id that attorneys use to contact USCIS ? Offcourse, I could have asked my attorney, but I thought I would post the question here first.

Your I-485 will not go forward unti they receive the 140 approval.
I-485 petition will be undated automatically as soon as the corresponding I-140 is approved.
As far as I know, you don't have to inform uscis about your I-140 approval.

Hi, My wife has started working on EAD as an individual contract employee and her employer is asking to complete W9 form. But in the form it says that only US citizen can complete that form. Also it asks for backup withholding. I am not sure what it is.
I am confused now. I know that EAD has no restriction in employment. Pl. help.

This is urgent please advise,
I was planning to join new empolyer with my EAD. I gave my Labor certificate to my manager, some how things are now going well with my new employer manager. Somehow I am in double mind whether to join or not join this new employer, I was just worrried since he has my labor certificate he can negatively affect me , if I do not join this new employer. Please advise if he can negatively affect me any way, or what precation I need to take in case I do not join him.

So far, the USCIS has announced that it received 5,900 H-1B applications for the normal quota and an additional 4,500 for the advanced degree quota. These numbers were released yesterday, April 7, 2011.
In years past, many remember that the H-1B quota was exhausted as early as the first day of applications. Last year, the H-1B cap was not reached until January the following year. I would anticipate that with the economy still rebounding, the H-1B quota will last a significant amount of time. This will also ensure that everyone who can find a job offer this year will have a chance to make an H-1B application.
