AC21 pioneers, any recommendations on picking lawyers around NYC? specifically those that are fairly responsive and charge a fair price on all the procedures / docs that come with maintaining AOS, including a possible AC21 notification letter, renewing EAD/APs....

Hi,
Currently I am on H1B visa.I will file my 485 as secondary applicant.What are my options in case If I have to leave my job and my 485 is still not approved.
Do I need to file H4 (Since 485 is still not approved) ?

You can status will be Adjustment of Status ( AOS ) but cant work . IYou need a APO if you want to travel . If you want to work you need an EAD .
Check with attorney .This is the essence of mail which i got from my attorney when asked regarding my son status

Hi all,
I need some good advice and facts...
My friend's H1-B extension is approved but the stamping (Mumbai consulate) might get denied due to a previous (dismissed) charge for driving with suspended license.
What are the options after that? Can he re-apply for the visa stamping again using the same H1-B approval petition? Can we appeal the decision since it document clearly states that the fine was paid?
Please advise.

If you have receipt # you can check the status on uscis.gov, you can also call their 1-800 # to check what's going on with this application.

Hi,
I am going back to India by next week. But my L1B extension is still pending (We applied for ext., before it expired and recieved RFE and responded. So as of now its more then 6 months from the date of I-94 expired and still my petition is in process).
My question is,
- while going back, do I need to show the copy of reciept in Port of Entry? (as I need to return my I-94 which is expired long back)
- Will it create any problem when I apply for extension again?
(My employer say, it shouldn't be a problem as I will have Approved/Denial notice which prove that I maintained legal status)
Or is it worth to wait here until I get the decision? (as I may cross 240 days by Jan, I am not sure whether the decision will come before that)...
Please adivce.

There has been no forward movement of the Employment cut-off dates for November. State Department explains that the reason for this is that it is still too early to see what impact the movement of the cut-off dates toward the end of FY-2007 may have on demand. Depending on the rate of demand being received from Citizenship and Immigration Services offices for adjustment of status cases, some forward movement of dates may be possible for December.

Hi all.
I just came back from Canada after 4 days using 30 day rule as I wanted to recoup few days so that my co. can apply for 7th year extension because my LC shall be pending for more than 365 days. My question is does my employer have to file two seperate LCAs for each I-129 application or same LCA copy can be attached with each I-129 ( 1st I-129 for extension for 3 days, 2nd I-129 for 1 year extension ) ?
( NOTE- MY I-94 WAS EXPIRING ON 15TH MAY AND LABOR CERT. SHALL BE PENDING FOR MORE THAN 365 DAYS ON 17TH MAY, SO I HAD TO TRAVEL OUTSIDE USA TO RECOUP FEW DAYS)

I have my MS (5 yrs back)
am currently enrolled in part time program..shoudl i give my current school info.
similarly in box 32 and 33..form 156
if i enter current employer is it ok to enter school name in 33...

anyone in the same boat???

Completed my 6 years on H1B and returned back to India on personal reasons.
1. When I apply for a new H1B after 1 year break, does the H1B comes under the quota or will it be considered on previously held H1B quota.

Application was sent out on 8/8/07.

My H1 stamping has expired. I have traveled using AP before. Just wanted to know if anyone traveled back with AP via Brussels?
Email I received from Belgium consulate just says "Indian nationals do not need transit visa". I am sure it means they do not bother about H1/AP as long as you have legal entry for the destination. Just wanted to re-check.

My spouse is on H4 currently. Have applied for H1 in April 2007 and got the H1 aproved. So the new H1 starts on Oct 2007. However, we applied for 485 and got our EAD's (No recept number, No finger printing etc).
Can my spouse use EAD to start job? we dont want use that new H1 currently. What are the implications if we use EAD? Will the H1 (and my H1) be effected?
