I receive the standard IRS letter regarding stimulus rebate.
I took this letter and went to SSA office to apply for a SSN for my wife.
Point number 3 in ss-5 clearly says .....
"If you check "Legal Alien Not Allowed to Work," you must provide a document from a U.S. Federal, State, or local government agency that explains why you need a Social Security number and that you meet all of the requirements for the U.S. government benefit. NOTE: Not all U.S. State or local benefits are acceptable for non-work SSN purposes. Contact SSA to see if your reason qualifies.
If you check "Other," you must provide a document from the U.S. government agency that explains why you need a Social Security number and that you meet all of the requirements for a Federal benefit except for the number."
I believe that IRS letter should be treated as a sufficient reason for need of SSN. BUT THEY DIDN'T ENTERTAIN ANY OF THE FACTS AND DECLINED TO ACCEPT APPLICATION FOR SSN.
They cannot refuse to accept your application. Fill in the forms and send them in. They can deny your application and then you can appeal. If they refuse to accept the application, you have two options. You can contact your congressman and complain. You can file a discrimination complaint with the SSA ombudsman. Here is the discrimination form.

Finally, if you believe you have been denied your rights because you are an immigrant, you can contact your local ACLU and ask them to represent your case. As a last resort, you can file a lawsuit at the federal district court. The filing fee for this is $350. However, I hope we are all doing this to exercise our rights rather than for the money. At least that is my motivation.
In my case, the first time I called, the person hung up on me. But I did not give up. I got them to accept the application and it is currently under reconsideration. I was also able to get a response from the Regional Office. So far they have not addressed any of the points I made in the original case as described in the OP. I expect they will continue to ignore their own laws and regulations, until I appeal this to an administrative judge, who will make a legal ruling.
BTW: All this costs you nothing but your time.

Berry Appleman really sucks. Dont ever go there.
I gave all my signed I485/G28/I325/I765/I131/693/Photos forms by June 8th. They filed mine on June 27th. They reviewed it for 17 days.
They never attend email or calls. Hope mine gets accepted.
I don't think Berry Appleman is a good firm, they took 30 days for all people to prepare simple docs for I 485 which takes 2 hours for us to prepare and they never respond to calls and email.

WASHINGTON -- Greeley Mayor Tom Selders wants to know when Congress is going to address immigration reform.
It's a simple question, but the answer is as elusive as the proverbial dog's tail -- a dizzying chase of vague answers and insufficient information.
"It seems to me like people are talking about immigration issues all over the country," Selders said. "I think that it is really sad that the government can't put a priority on it."
The latest source of Selders' frustration was a meeting of business and community leaders in late January with Sen. Wayne Allard, R-Colo.
"We were disappointed with Allard's response," Selders said.
Sean Conway, Allard's chief of staff, said Allard never promised to bring up immigration at this particular delegation meeting.
"What he talked about was that he would be glad, as the process began to move forward and as concerns were brought forth, to pass those concerns on" to the delegation, Conway said.
Conway said Allard would very much like to see the issue brought up in the Senate, but that as far as he knew, it was not at the top of the Democratic agenda. "This is an issue (Allard) very much wants to be involved with and has been involved with," Conway said.
But Sen. Ken Salazar, D-Colo., said immigration was a major issue that would be addressed this year, maybe as early as March.
"I think it is just a matter of time as to when we are able to get to it and I hope it is sooner than later," he said. Salazar is working with the Senate leadership on the immigration legislation, which will be sponsored by Sen. Ted Kennedy, D-Mass., and Majority Leader Sen. Harry Reid, D-Nev.
But for Selders, soon is not quick enough.
"We have frustration here. We see a lot issues and turmoil and some very nasty comments," he said. "(City officials) have all taken oaths of allegiance we will enforce the laws of this land and the frustration is that we lack the resources to do that. The laws are unclear and we lack jurisdiction."
Immigration's National Outlook: Cloudy
Outside of the Colorado delegation, consensus and clarity on when the immigration will receive top billing by Congress is not much better.
Congress, under Democratic control, is actually in tune with President Bush on immigration for the first time in years. Despite this, few observers believe that a comprehensive immigration bill will pass this year.
One of the few is Bob Dane, press secretary for the Federation for American Immigration Reform, who said President Bush and the Democrats were "locked and loaded" to pass immigration reform that included a guest worker program, or "amnesty."
"I don't see how immigration can be an issue leading up to the 2008 election," he said. "It's such a volatile issue. We are guessing that they want to get it done before the election."
But John Keeley, director of communications for the Center for Immigration Studies, a think-tank that researches immigration, was not certain. He said many of the freshman democrats, known as "Blue Dogs," who gave the Democrats the majority, were elected on immigration platforms that were against a guest worker program, favored by Bush and the Democratic leadership of Congress.
"On the horizon of the 2008 general election we tend to think that it is not likely we will see significant legislation," as opposed to last year, he said.
Keeley said instead of landmark legislation, lawmakers will try to pass bills or amendments that only address small pieces of the issue.
That process has already begun. A bill was introduced in the Senate that would set up a guest worker program just for agriculture workers. In addition, a provision has been attached to minimum wage legislation that would withhold federal contracts from any company found hiring illegal immigrants.
But the Democratic leadership is hoping to have a comprehensive immigration bill on President Bush's desk by the end of the year.
Laura Capps, a spokeswoman for Sen. Ted Kennedy, D-Mass., said the senator, who is the Senate subcommittee chair on immigration, border security and citizenship, was hoping to have the Senate bill introduced in late February or early March. Capps did not know of an exact date yet.
The real fight is expected in the House, not the Senate, which passed bipartisan legislation last session. The Republican House leadership was uninterested in the guest worker program, however, and only discussed the border enforcement aspect --the so-called 700-mile border fence.
Rep. Zoe Lofgren, D-Calif., the chairwoman of the House subcommittee on immigration, border security and claims, plans to begin the committee process "promptly." But her spokeswoman, Kyra Jennings, said no date has been set to begin consideration of an actual bill.

Then by the evening my I-485 said
"Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Notice mailed welcoming the new permanent resident.
On June 30, 2008, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. What I refute is the argument portrayed by misinformed members that the shift in power was caused significantly by the anti illegal alien position. It is not true. That's all I am saying.
Contrary to belief of some members, I am not disappointed with this. I will continue to be your Ombudsman as usual and report everything, probably you will hear more good news for those who believe that amnesty is the way to go. Facts are facts. I am not here to defend any side.

Appu, what abt labor cert? Does this advanced degree-holder still have to go thru labor cert? If yes, then the person with advanced degree but no experience has no advantage.
Here's the summary from Sen Frist's website:
So if you would have qualified for the F-4 visa if this bill had been in effect at the time of your graduation and you have secured employment in the US, you can adjust your status.
Plus, Section 406 says: if you have been employed for 3 years, then a visa number will be immediately available to you. Otherwise, Section 405 still says you have to wait till a visa number is available.

Thumb-up for the DC Rally! I think our efforts will be long-term. We got to get the idea across to as many people as possible. Rally is powerful, but we also need to use other types of campaign--big or small to get our voice heard.
One idea my American friend shared with me was to make presentations at retirement centers or community centers/ events. We need to be visible and our contribution to the country made known.

I wanted to volunteer a thought that had been in my head, so I am basically thinking out loud here for a bit, just throwing this out there for your guidance, tell me if you think this is too aggressive, or even premature?
I think we need another rally before the end of the year. There are 2 reasons:
1- Presidential campaigns: After this Fall, presidential campaigns will be in full swing, and thus commanding all the attention of Congress, the media and the American public.
2- Memory: People's memories are short. Now that we have the attention of the media and Capitol Hill, wouldn't it make sense that this is the time to redouble our efforts and push harder? If we wait, the iron might just cool off.
Having said that, and as we know, a rally means a lot of money, a lot of work, a lot of dedication to organize. Yet, no one said our struggle was easy, and other people and groups who have gone through tough struggles have had to go through extraordinary lengths to achieve their goals.
So, if we were to hypothetically hold a second rally this Fall, we could go for the "low-hanging fruit", i.e. we can hold the rally where the most of us live, such as Silicon Valley (and we know those folks really come through), we can plan to reach attendance to this event in the tens of thousands. I know we might not have enough time, and the people who worked so hard on the DC rally are probably exhausted. One idea my American friend shared with me was to make presentations at retirement centers or community centers/ events. We need to be visible and our contribution to the country made known.

I wanted to volunteer a thought that had been in my head, so I am basically thinking out loud here for a bit, just throwing this out there for your guidance, tell me if you think this is too aggressive, or even premature?
I think we need another rally before the end of the year. There are 2 reasons:
1- Presidential campaigns: After this Fall, presidential campaigns will be in full swing, and thus commanding all the attention of Congress, the media and the American public.
2- Memory: People's memories are short. Now that we have the attention of the media and Capitol Hill, wouldn't it make sense that this is the time to redouble our efforts and push harder? If we wait, the iron might just cool off.
Having said that, and as we know, a rally means a lot of money, a lot of work, a lot of dedication to organize. Yet, no one said our struggle was easy, and other people and groups who have gone through tough struggles have had to go through extraordinary lengths to achieve their goals.
So, if we were to hypothetically hold a second rally this Fall, we could go for the "low-hanging fruit", i.e. we can hold the rally where the most of us live, such as Silicon Valley (and we know those folks really come through), we can plan to reach attendance to this event in the tens of thousands. I know we might not have enough time, and the people who worked so hard on the DC rally are probably exhausted. We are Canadians too. IRS ruling is that if even a single person on your tax does not have a SSN, no one gets any stimulus money. Seems too weird, but that's what they say. For paying taxes, we are considered "US Persons", and should pay taxes not only on US income, but on World income (even on RRSP income within the plan unless you make a special filing to get exemption).
We are Canadian and on a visa, our son is an American citizen and we also cannot get the stimulus, not even our son's $300 which is wrong!
People do not care about the immigration problems because most do not know about them or understand them. It is a very unjust system that encourages illegal immigration and discourages allowing educated, upstanding people from coming here.

I think the country based quota has been eliminated for the "merit based" quota. Am I missing something.
The original bill had a 10% per country cap. Don't think that has been removed in the new bill.

Sc3 and other friends. Here is what has triggered this bad blood on the forum
Apr VB EB2 is U and EB3 is doing well every one is normal exactly like every other VB no surge of threads and replies everything is normal
July VB Eb2 is in Apr 2004 and Eb3 is in U again every thing is normal
Aug VB Now suddenly Eb2 is 2006 and Eb3 is U ( no change) and all of a sudden there is a flood of e-mails complaining injustice against EB3. I think the timing of when Eb3 folks realized injuistice is what ticked off many.
I am not saying every one shares this feeling but just the sheer volumes of posting on this thread speaks for itself. I am sure many do not agree with me (or least pretent not to agree) Any one can query Eb3 injuistice posting before Aug VB and compare it since this bulletin was posted and see the data speaks for itself we do not need any body to prove anything
In fact looking at statistics posted by sachug22 here (http://immigrationvoice.org/forum/showpost.php?p=265004&postcount=20), it looks like it is EB2 that got shafted all along and finally DOS/USCIS realized their folly and tried to correct the spillover rule starting this april (as explained in July'08 bulletin). This re-interpretation does not affect EB3-I negatively. I do not know why so many are getting riled up over EB2 progress.

You are talking as if IV made this change possible. This is nothing but conspiacy theory that you have made up. It was entirely CIS decision to reinterpret the spill over rules. I had never heard any of IV member on this forum or in state chapter updates talking about spill interpretation campaign. This has been a suprise for most people ( a pleasant for some of us) You tell me what can IV do here tell CIS to revert back to EB3 ROW in which case both Eb2 & Eb3 Ind remain U for time eternity.
