It does make sense that the overflow numbers are given to higher preference categories in single state oversubscribed countries. When you think about it, will that not be the most beneficial to United States? Who would you prefer .... and Unskilled professional from a ROW category or a skilled worker from an Oversubscribed country. I would gather it would make more sense to give the opportunity to the higher skilled since the benefit to US will be higher

I m a new applicant for EB 3 gc born in india.....just starting my process......with my PD being sometime in later half of 2009,do u think canada is a better option?......EB 3 india right now looks like a good 10-12 years wait time!!.......pls advice about canada immigration and is it a viable option?

I speak Hindi and have 8-9 friends from south india..telegu, tamil and kannadiga........we have been hanging out for years now and we haven't faced any problems....2-3 ppl in our group don't know hindi well and they try to learn it.
I have learned a few telugu and tamil words........I find calling the attitude of hindi ppl rude is a bad omen. If you don't like hindi, why do u like british language english.
I'm surprised when ppl say they hate hindi (which many indians speak) but talk to the foreign clients in their language with a smirk on their face. Take it easy friends. Cool down.

Thanks for the reply. I talked to IRS and was on the phone with them for 1.5hrs and she said I can apply for her ITIN even though she is not here.

I got biometrics notice for an appointment in the past :mad::mad::mad:
So, I made copies of the notice and put together cover leter and asked to be rescheduled for Sep.
Will call next week to follow up. In the meantime I noticed soft LUD on the date of my supposed biometrics....but the online message still says document production ordered....
Total chaos guys....:mad:

Fragomen employees are told they represent the company. The company is their client. They are a corporate law firm. There are instances when the law firm represents you, the foreign national. Usually this is when you are applying via a marriage based case, or are in the final green card process and it has reached portability. There is information that law firms cannot release to you as some information requested belongs to the client, and they must receive authorization from the client. Yes, I used to work for Fragomen, before anyone wants to assume anything. I was a paralegal and worked hard for every case that was given into my hands. I specialized in the green card process and made sure I responded to every foreign national as quickly as I can. Please understand that paralegals and legal assistants are subject to the attorneys they work for. Therefore, some questions you may ask require an attorney to respond, and the paralegal or legal assistant's delay may be in trying to get the answer you require. I know not all Fragomen offices work the same. Not all will respond to you in the same manner. Some may be worse than others. So if you are going to defame Fragomen, would you please try to specify which office you are referring to?
I have read through all the posts on this thread and I know some of you have positive experiences, while others have had very negative experiences. To those of you who have had negative experiences, I am sorry that your case went to someone who only looked at their work as a job. I also heard a lot of different things from some of my friends not sure if all of them are true or not. I have heard that people who did Labor substitution or converted from EB3 to EB2 are getting unusually high number of RFEs compared to others. Also DOL seems to be tightening up and scrutinizing EB2 applications vigorously(this is hear say don't take my word for this). Personally the one fact that I can vouch for from my experience with my family and vast circle of friends that did apply for Green cards is that people with a straight forward EB2 application had much higher chances of getting approved even with a later priorty date. I know four friends with a PD of June 2005 EB2(and many more with earlier PDs) from one retrogressed country who got green cards during that 1 month in July 2007 when all the dates were current. But I also have several friends who are either EB3 to EB2 conversion or EB3 with much earlier PDs (2002/2003) who unfortunately are still waiting for their I 485 approval even with an earlier PDs(most of them even did PERM Labor with transfer of PD or EB3 to EB2). many of them are still replying for RFE for one or the other issue. Does having a complicated application with EB3 to EB2 transfers/ Labor substitution delay the processing or lead to more scrutiny from USCIS? I don't know. I would like to know more from the other friends in the forum who have received RFE recently regarding their experiences. Also any straight forward EB2 filers who got RFEs please post your experience.

Or why not cover both aspects of H visa (H1 & H4). Both visas come with their own set of problems, challenges, and disappointments for the visa holders. Besides, H1 and H4 go hand in hand and story on one is not complete without mentioning the other. If I were the film maker, I would seriously consider both.
If you only talk about either one of these visas by themselves, you'll be looking at only the half of the picture.

In a sense, H-1b holders are also dependent, on the employer, who is merciless compared with the the H-1 holder on whom the H-4 is dependent.

The cutoff dates are listed for individual countries only if they make up more than 7% of total visas for that year. In case of rest of the world the numbers are not impacted by per country limits so they are not listed separately. So all these applications are part of the same pool and not as retrogressed as the listed countries.

I just found out that I will not be getting the stimulus as my wife is cannot get a SSN. In addition, we will not be getting stimulus amount for our American born daughter.
We have been here for a year and a half and while there are some benefits to being in America, my wife and I are trying hard to understand why we moved here from Canada (saving taxes is no benefit when compared to having to deal with ignorance all around). My being here is benefiting an American company (which did not have the expertise that I brought to them and this country) and thereby this country.
If I were to leave the company, a number of people would lose their jobs and I would take my expertise somewhere else.....
Is it true that almost everything done in America is poorly planned and lacks foresight and common sense? Our experience here to date is giving us this impression.....
I would be interested in joining with others against the IDIOTS who don't understand who is benefitting this country.
I totally agree with you. I came from Canada too and my wife went to college here, got her nursing degree and RN. Not able to file for GC because of the mess. She is working in an industry which has high demand and lack of people. Health care will be worst for those American baby boomers. Waiting for my kids to go to college ( 4 more years ) and move back to Canada.

They hushed up and approved my EAD in 20 days. Why ???? 'cos So they don't hit Jun'30 and give 2 years. They wanted to milk another 680 from me so they hushed up and sent me the 1 year EAD in 20 days.

Here is my take on usabal, the firm is well known in the Bay Area, so if you are in that area, you are ok.
For TX, they acquired the firm Jenkens and Gilchrist last year. Jenkens attorneys are very conservative, and if you happen to work for a big employer who has hired Berry, Appleman... you are screwed.
They may still work out ok for you on an individual basis, I would stay away from their TX office for sure.
Berry, Appleman & Leiden LLP is very good firm. I have very good experience with them. They completed all my paper work on Jun 30, so that they can file by July 2. Also the attorney and the para-legal were really good and replied to my questions patiently. The website is http://www.usabal.com/
